How asset division works in India

Unlike many western jurisdictions, India has no community-property regime — assets are not automatically split 50/50 on divorce. Courts decide case by case based on ownership proof, each spouse’s financial and non-financial contribution, the length of the marriage, and the welfare of children.

In a mutual consent divorce, the settlement is whatever the two parties agree to and record in the petition — which is why estimating a fair split before negotiation matters. In a contested divorce, the court determines division alongside maintenance under Section 125 BNSS and Streedhan recovery under the Hindu Succession Act.

How are assets divided in an Indian divorce?

India has no community-property law — there is no automatic 50/50 split. Courts divide assets case by case, weighing ownership documents, each spouse's financial contribution, the length of the marriage, and the welfare of children. Jointly-held property may be sold and divided, or one party may keep it with compensation to the other.

What is Streedhan and who keeps it?

Streedhan is the ornaments, gifts, and valuables given to the wife before, at, or after marriage. Under Section 14 of the Hindu Succession Act it is her absolute property, and courts will rarely order its division. It is separate from dowry, which is illegal.

Is maintenance separate from the asset settlement?

Yes. Maintenance under Section 125 BNSS is assessed separately from asset division. However, regular maintenance payments may reduce a one-time lump-sum settlement claim, and courts often look at both together when finalising terms.
